1. Agreement to Terms

Welcome to My Strategy Quest! These Terms of Service ("Terms") constitute a legally binding agreement between you and Kitty from Outer Space Ltd, a company incorporated in New Zealand ("Company", "we", "us", or "our").

By accessing or using My Strategy Quest at mystrategyquest.com (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

These Terms are governed by the laws of New Zealand, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Contract and Commercial Law Act 2017.

2. Description of Service

My Strategy Quest is an AI-powered life design tool that helps users:

• Map life domains and values
• Define observable outcomes
• Design and track experiments
• Engage in guided reflection through AI companions
• Manage personal and professional workspaces

The Service includes AI-powered features that use large language models to provide conversational assistance. While we strive for accuracy, AI-generated content should not be considered professional advice (medical, legal, financial, or otherwise).

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access
• Be responsible for all activities under your account

You must be at least 16 years old to create an account. If you are under 18, you confirm that you have the consent of a parent or guardian.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable New Zealand or international law
• Infringe on intellectual property rights of others
• Harass, abuse, or harm another person
• Upload malicious code or attempt to compromise system security
• Use the AI features to generate harmful, illegal, or deceptive content
• Attempt to extract or reverse-engineer AI model weights or training data
• Resell or commercially exploit the Service without our written consent

5. Intellectual Property

Our Content: The Service, including its design, code, AI agents, pixel art assets, and branding, is owned by Kitty from Outer Space Ltd and protected by New Zealand and international copyright and trademark laws.

Your Content: You retain ownership of all content you create using the Service (domains, outcomes, experiments, notes, etc.). By using the Service, you grant us a limited licence to store, display, and process your content solely to provide the Service to you.

AI-Generated Content: Content generated by our AI companions is provided for your personal use. You may use such content freely, but we make no warranty as to its accuracy or fitness for any particular purpose.

6. Payment Terms

If you subscribe to a paid plan:

• All prices are displayed in New Zealand Dollars (NZD) and include GST where applicable
• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel at any time; access continues until the end of the billing period
• Refunds are provided in accordance with the Consumer Guarantees Act 1993

7. Consumer Guarantees

Under the Consumer Guarantees Act 1993, if you are acquiring the Service for personal use:

• The Service will be provided with reasonable care and skill
• The Service will be fit for purpose and match its description
• You have remedies available if we fail to meet these guarantees

Nothing in these Terms excludes or limits your rights under the Consumer Guarantees Act 1993 or other consumer protection legislation that cannot be excluded by agreement.

8. Limitation of Liability

To the maximum extent permitted by New Zealand law:

• The Service is provided "as is" without warranties beyond those required by the Consumer Guarantees Act 1993
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for decisions you make based on AI-generated content

These limitations do not apply where prohibited by law, including under the Consumer Guarantees Act 1993 for consumer transactions.

9. Termination

You may close your account at any time through your account settings or by contacting us.

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay applicable fees

Upon termination, you may request an export of your data within 30 days. After this period, we may delete your data in accordance with our Privacy Policy.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 14 days before they take effect.

Continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the changes, you may close your account.

11. Dispute Resolution

If you have a dispute with us:

2. If unresolved within 30 days, either party may refer the dispute to mediation
3. If mediation fails, the dispute will be resolved by the courts of New Zealand

Nothing in this clause limits your right to take action under the Consumer Guarantees Act 1993 or to make a complaint to the Commerce Commission.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction over any disputes arising from these Terms.
